CO Governor Signs Bill Penalizing Employers for Misclassifying Employees as Independent Contractors
An Act Concerning the Misclassification of Employees as Independent Contractors

Colorado Gov. Bill Ritter has signed a bill that penalizes employers that misclassify employees as independent contractors in order to avoid the payment benefits and employment taxes.
The legislation, passed in the House by a vote of 80 to 2 on April 8, 2009 and then passed at the Senate on May 8, 2009, creates the office of employee misclassification (“Office) in the division of employment and training (“Division”) in the department of labor and employment (department) for the purpose of investigating complaints of employers misclassifying employees as independent contractors.
