Department of Labor Issues Final Rule on H-2A Worker Program
Final Rule on Temporary Agricultural Employment of H–2A Aliens in the United States

The Department of Labor (“DOL”) has issued a a final rule governing labor certification process and enforcement mechanisms for the H-2A temporary agricultural worker program. The DOL has published this rule in the Federal Register to strengthen worker protections for both U.S. and foreign workers and to ensure overall H-2A program integrity. The rule will start to take effect on March 15, 2010.
By way of background, the H-2A nonimmigrant visa classification applies to foreign workers coming to or already in the U.S. to perform agricultural work of a temporary or seasonal nature. The U.S. Department of Homeland Security may not…
