Digital Performance Right in Sound Recordings and Ephemeral Recordings

The Copyright royalty Board has issued new regulations governing the rates and terms for two statutory licenses. These licenses refer to the grant of certain digital performances of sound recordings and the making of ephemeral recordings. The new regulation applies to license apply to the license beginning January 1, 2006 and ending on December 31, 2010.
The highlights of this new regulation is that it establishes the rates and terms of royalty payments for the public performance of sound recordings in certain digital transmissions by licensees in U.S.C. 114, and the making of Ephemeral Recordings by licensees pursuant to the provisions…
