Federal Law Banning Employment Discrimination Based on Genetic Information to Take Effect on November 21, 2009
Genetic Information Nondiscrimination Act of

Title II of the Genetic Information Nondiscrimination Act of 2008 (“GINA”) goes into effect for employers of 15 or more employees on November 21, 2009.
GINA, signed into law in May 2008 by then U.S. President George Bush, prohibits discrimination by health insurers and employers based on people’s genetic information. The Equal Employment Opportunity Commission (“EEOC”) is charged with issuing regulations implementing Title II of GINA, which prohibits the use of genetic information in employment, prohibits the intentional acquisition of genetic information about applicants and employees, and imposes strict confidentiality requirements.
